OVERVIEW

Welcome to Provocateur. When you enter our world—online or off—you agree to our rules. “We”, “us”, and “our” mean Provocateur. These Terms, plus any referenced policies, are your contract with us. Read them. By using our site or services, you accept these Terms and our Privacy Policy. Don’t like it? Don’t play.

1. ACCESS AND ACCOUNT

  • You must be of legal age where you live. You’re responsible for your account and everything done with it—guard your credentials.

  • You’re responsible for providing true, current, complete info every time. All activity under your account is on you. No sharing, selling, or licensing your account.

2. OUR PRODUCTS

  • We show our gear honestly, but screens can deceive. Colors and finishes may look different in real life.

  • We don’t guarantee your expectations will match reality. Products, descriptions, and availability can change at any time—no notice required.

  • We can limit or refuse sales to anyone, anywhere, at our sole discretion.

3. ORDERS

  • Placing an order is making an offer—Provocateur calls the shots on acceptance.

  • Orders are confirmed by us, not before. Payment must clear first.

  • Once accepted, orders may not be cancelled. If we refuse or change your order, we’ll try to notify you.

  • Returns and exchanges follow our Refund Policy.

  • You promise your purchases are for personal use—not for resale or export.

4. PRICES AND BILLING

  • Prices, discounts, promos—subject to change anytime. The price at checkout is what you pay.

  • Prices exclude taxes, shipping, customs, unless stated otherwise.

  • You promise all payment info is legit and you’re authorized to use it. You’ll cover all charges, including taxes and shipping.

5. SHIPPING AND DELIVERY

  • Delivery times are estimates, not guarantees. We’re not liable for delays, customs, or carrier issues. Once your order ships, risk and title are yours.

6. INTELLECTUAL PROPERTY

  • Everything—designs, text, images, logos, content—belongs to Provocateur or our licensors. No stealing, copying, or remixing without written permission.

  • Our names, logos, and marks are Provocateur property. Don’t use them without consent.

7. OPTIONAL TOOLS

  • Sometimes you’ll use tools from third parties. Use at your own risk—no endorsements, no warranties, no liability from us.

  • Future features? Same rules apply.

8. THIRD-PARTY LINKS

  • We may link to third-party sites. What happens there is on you. We’re not liable for any harm, loss, or shady business outside our domain.

9. RELATIONSHIP WITH SHOPIFY

  • We’re powered by Shopify, but your deal is with Provocateur. Shopify isn’t responsible for your order or any claims. You release Shopify from all liability related to your purchase.

10. PRIVACY POLICY

  • Your data is protected by our Privacy Policy [LINK] and Shopify’s policy. Using our site means you’ve read and accepted both.

11. FEEDBACK

  • If you send us ideas, reviews, or feedback, you grant us a royalty-free, perpetual license to use, publish, and adapt it however we want. You confirm you own your feedback and it’s legal. We’re not obligated to keep it confidential or pay you.

12. ERRORS, INACCURACIES AND OMISSIONS

  • Sometimes info on our site isn’t perfect. We reserve the right to fix errors, update info, or cancel orders at any time—no notice needed.

13. PROHIBITED USES

  • No illegal, abusive, or shady behavior. Don’t hack, spam, exploit, or harass anyone. Don’t violate any laws or these Terms. We can suspend or terminate your account for violations.

14. TERMINATION

  • We can terminate your access at any time, for any reason. Surviving sections (like IP, feedback, indemnity, law) remain in force.

15. DISCLAIMER OF WARRANTIES

  • Everything is provided “as is.” No guarantees, no promises, no warranties—express or implied. You use our site and products at your own risk. 

  • Provocateur is not liable for any harm, injury, or damage caused by the use or misuse of our products. All gear is used at your own risk. Know your limits, play responsibly, and obey your desires with care.

16. LIMITATION OF LIABILITY

  • To the fullest extent allowed by law: Provocateur and our partners, affiliates, and Shopify aren’t liable for any damages, direct or indirect, arising from your use of our site or products.

17. INDEMNIFICATION

  • If your actions cause us trouble, you’ll cover our costs, including legal fees. We may control our defense and settlement.

18. SEVERABILITY

  • If any section is found unenforceable, the rest of the Terms stay intact.

19. WAIVER; ENTIRE AGREEMENT

  • If we don’t enforce a right or clause, it’s not a waiver. These Terms (plus posted policies) are the full agreement—superseding all prior versions.

20. ASSIGNMENT

  • You can’t transfer your rights under these Terms. We can assign ours without notice.

21. GOVERNING LAW

  • Dutch law rules. Disputes go to courts in Arnhem, The Netherlands.

22. HEADINGS

  • Headings are for clarity only—they don’t affect interpretation.

23. CHANGES TO TERMS OF SERVICE

  • We can update these Terms anytime. Major changes? We’ll notify you. Keep checking for updates. Continued use = acceptance.
